ESTEVAN — The man charged in connection with a homicide in Estevan earlier this year had his matter discussed in Estevan Provincial Court again on Sept. 8.
Evan Dennis Isbister is charged with second-degree murder in connection with the death of his father Todd in May.
After a discussion about setting dates for a preliminary hearing, which is expected to last three days, Judge Mitch Miller noted they wouldn’t be able to finalize the schedule, as this would be a lengthy matter. He added he recognizes the defence wants to have the session “sooner rather than later”.
He asked both sides to provide dates that would work, because it would take a special sitting and a relief judge would be needed for the southeast.
Evan Isbister has elected to have a trial in Court of King’s Bench before a judge and jury. The preliminary hearing will determine if there is enough evidence for the case to proceed to trial.
His case was adjourned to Sept. 29. Isbister is currently out on bail.
Background: In a news release, the Estevan Police Service said that at approximately 8:46 p.m. on May 10, officers were dispatched to a residence in the 1400-block of First Street. The caller reported an assault was taking place.
When the EPS arrived, they said officers located three men in the residence. The EPS said two were arrested without incident and taken to the police station. Estevan EMS responded to the scene to care for the victim and transported him to St. Joseph’s Hospital for treatment. He died from his injuries a short time later.
According to the EPS, one of the arrested men was cleared of any wrongdoing and was subsequently released from custody. The other man arrested was Evan Isbister.
He was released from custody with conditions in June following a show-cause hearing in Estevan Court of King’s Bench.
