West Wind Aviation is being sued by a passenger on one of their planes that crashed while attempting to leave Fond-du-Lac in December 2017.
David Opper of Brantford, Ontario says he sustained “lasting physical and emotional damages” as a result of the crash. He filed a statement of claim in Regina Court of Queen’s Bench this week.
The plane, with 22 people on board and three crew members, crashed moments after taking off. One passenger died two weeks after the crash.
A final report on the incident has not been made by the Transportation Safety Board, but they have said the plane was not de-iced before takeoff.
The crash forced West Wind to shut down operations for five months before they were given clearance to fly again.
The claim from Opper, who is a physician that was working in the area at the time, alleges West Wind failed to provide duty of care in many ways including delivering adequate emergency instruction to passengers. He adds those on board were left to fend for themselves in the aftermath of the accident and there was no indication from the pilot or flight staff that there were problems.
